Terms and conditions

 

1 Definitions

In these terms and conditions:

“Declaration” means the declaration made by the Entrant in respect of the Prize Draw as part of the Entry, including these terms and conditions;

“Entrant" means the organisation entering the Prize Draw and (if successful) receiving the Prize;

“Entry” means the entry submitted by the Entrant in respect of the Prize Draw;

“Entry Period” means [13.05.2026] to [21.06.2026] as may be updated by Severn Trent in accordance with these terms from time to time;

“Prize" means a prize of up to £1,000 awarded by Severn Trent under the Prize Draw;

“Prize Draw" means the ‘Kits for Kids’ random prize draw conducted by Severn Trent in accordance with clause 2;

"Severn Trent" means Severn Trent Water Limited (and any company in the Severn Trent plc group), including its employees and partner organisations.

2 The prize draw

2.1 The Prize Draw shall be conducted by Severn Trent using a randomised selection procedure.

2.2 Each eligible Entrant who submits a valid Entry during the Entry Period specified by Severn Trent shall be entered into the Prize Draw.

2.3 Only one Entry per Entrant is permitted.

2.4 The Prize Draw will be conducted on such date(s) as Severn Trent shall determine and notify to Entrants in advance.

2.5 The winning Entrant will be notified by Severn Trent by email or telephone within a reasonable period following the Prize Draw.

2.6 If the winning Entrant does not respond to Severn Trent within 14 days of being notified, the Prize will be forfeited and Severn Trent will be entitled to select another winner in accordance with the process described above.

2.7 Severn Trent’s decision in respect of the Prize Draw is final and no correspondence will be entered into regarding the outcome.

2.8 Severn Trent must either publish or make available information that indicates that a valid award took place. To comply with this obligation, Severn Trent will send the name of the winning Entrant to anyone who requests this information by email to communityfund@severntrent.co.uk within one month after the closing date for Entries. If the winning Entrant objects to any such information being published or made available, the Entrant should contact communityfund@severntrent.co.uk in such circumstances. Severn Trent must still provide the information to the Advertising Standards Authority on request.

3 Prize payment

3.1 Submission of an Entry does not guarantee that a Prize will be awarded. An Entrant will not be deemed

to have won a Prize unless expressly notified by Severn Trent that a Prize has been awarded.

3.2 Payment of the Prize is subject to the Entrant’s Entry being valid, the completion of any final checks to Severn Trent's satisfaction, and confirmation of eligibility by telephone or other means.

3.3 Severn Trent will pay the Prize by bank transfer (BACS) into a UK-based bank account or building society account in the Entrant’s name.

3.4 The Entrant will notify Severn Trent immediately of any changes to the Entrant’s bank account details.

3.5 The Entrant acknowledges that the Prize is not consideration for any taxable supply for VAT purposes. The Prize is inclusive of any applicable VAT.

3.6 The Prize is limited to the amount stated and Severn Trent shall not be obliged to pay any amount in excess of the Prize.

4 Use of the prize

4.1 The Prize is made subject to the terms of the Entry and Declaration. The Entrant shall use the Prize for the purposes of youth football as set out in the Entry.

4.2 The Entrant will not use any part of the Prize for purposes other than those described in the Entry and the Declaration without Severn Trent's prior written approval.

5 Entrant organisation

5.1 The Entrant warrants that the Entrant is a youth football club or other eligible organisation and that acceptance and use of the Prize is within the scope of the Entrant’s governing documents or constitution.

5.2 The Entrant will act in a fair and open manner without distinction as to race, religion, language, age, gender, sexual orientation or disability, and in compliance with all relevant legislation.

5.3 The Entrant will comply with all laws and regulations applicable to the Entrant’s activities, including (but not limited to) those relating to equality, safeguarding, and health and safety.

5.4 The Entrant will obtain, and be responsible for obtaining, all approvals and licences required by law in connection with the use of the Prize.

5.5 The Entrant will notify Severn Trent in writing as soon as reasonably practicable if:

5.5.1 any legal claims are made or threatened against the Entrant which could adversely affect the use of the Prize;

5.5.2 any investigation concerning the Entrant’s organisation, trustees, directors, employees, or volunteers is commenced by the Police, the Charity Commission, HM Revenue & Customs, or any other regulatory body;

5.5.3 the Entrant’s organisation is to be dissolved, wound up, or becomes insolvent; or

5.5.4 there is any change to the Entrant’s governing document which materially affects the Entrant’s ability to comply with these terms and conditions.

5.6 The Entrant will not transfer any part of the Prize or any rights under these terms and conditions to another organisation or individual.

5.7 The Entrant will maintain adequate and appropriate insurance at all times, including public liability insurance and any other insurance appropriate to the Entrant’s activities. The Entrant will supply copies of insurance documentation to Severn Trent on request.

6 Branding, publicity, and acknowledgement

6.1 The Entrant will acknowledge the Prize publicly in accordance with the commitments in the Entry and Declaration.

6.2 The Entrant will at all times follow Severn Trent's branding and publicity guidelines, as notified to the Entrant from time to time.

6.3 The Entrant will acknowledge Severn Trent's support in any relevant published materials, such as advertisements, accounts, or annual reports.

6.4 The Entrant consents to Severn Trent carrying out any publicity and marketing to promote the award of the Prize as it sees fit and will assist Severn Trent with any reasonable requests for publicity or marketing, including press or media-related activities.

6.5 By sharing images, videos, and updates with Severn Trent (including by sending them to the Severn Trent team, tagging Severn Trent, or using #STkitsforkids), the Entrant grants Severn Trent a worldwide, perpetual, royalty-free, irrevocable, non-exclusive licence to use, reproduce, distribute, and publish such Prize Media in any format or medium, including but not limited to:

6.5.1 websites owned and operated by Severn Trent;

6.5.2 social media platforms (including Facebook, Nextdoor, Instagram, and LinkedIn);

6.5.3 promotional, press, and marketing materials; and

6.5.4 corporate publications and future prize draw campaigns.

6.6 The Entrant warrants that it has obtained all necessary consents (including, where applicable, parental or guardian consent for images of children) prior to sharing any Prize Media with Severn Trent.

6.7 Severn Trent has the right to reproduce any part of the Entry or any subsequent information the Entrant supplies for any purpose, without any claim by the Entrant in respect of copyright or intellectual property.

7 Monitoring and reporting

7.1 The Entrant will provide reasonable updates or evidence of use of the Prize to Severn Trent if requested.

7.2 Severn Trent may request Prize Media at any time, and the Entrant agrees to use reasonable endeavours to comply with such requests.

7.3 The Entrant will notify Severn Trent immediately in writing of anything that significantly delays or prevents the use of the Prize for its intended purpose.

7.4 The Entrant will keep (and make available to Severn Trent on request) proper records, including receipts, showing how the Prize has been used. The Entrant will retain such records for a minimum of six years following receipt of the Prize.

8 Repayment and withdrawal

8.1 Severn Trent may demand repayment of all or part of the Prize, at its absolute discretion, in any of the following circumstances:

8.1.1 the Entrant fails to comply with any of these terms and conditions, the Entry or the Declaration;

8.1.2 any information provided in the Entry or otherwise in connection with the Prize or

the Entrant is found or suspected to be false, misleading, or inaccurate;

8.1.3 the Entrant or any person employed by, representing or connected to the Entrant acts dishonestly, negligently, or in any way that is in Severn Trent’s opinion detrimental to the organisation, the Prize, or Severn Trent's reputation;

8.1.4 the Entrant’s organisation or any of its officers, employees, or volunteers become subject to an investigation by the Police, the Charity Commission, HM Revenue & Customs, or any other authority or regulatory body;

8.1.5 the Entrant receives duplicate funding from another source for the same purpose;

8.1.6 there is a significant change of purpose or recipient such that Severn Trent judges the Prize is unlikely to fulfil its intended purpose;

8.1.7 the Entrant becomes legally ineligible to hold the Prize; or

8.1.8 Severn Trent has reasonable grounds to believe that repayment is necessary to protect the integrity of the Prize Draw.

8.2 Where Severn Trent requires repayment of a Prize in accordance with clause 8.1, unless otherwise specified by Severn Trent, the Entrant shall repay to Severn Trent the full amount of the Prize to the bank account nominated by Severn Trent within seven (7) days.

8.3 Severn Trent may reject any future entry from the Entrant if the Entrant fails to comply with these terms and conditions.

9 Liability

9.1 Subject to clause 9.2, Severn Trent accepts no liability for any consequences, whether direct or indirect, arising from the Entrant’s use of the Prize or from any withdrawal of the Prize.

9.2 Nothing in these terms and conditions shall limit or exclude any liability of Severn Trent where it would be unlawful to do so.

10 Data protection

Severn Trent will process personal data provided in connection with the Prize Draw in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and Severn Trent’s privacy notice, available at www.stwater.co.uk/help-and-contact/legal/privacy/.

11 Duration

These terms and conditions come into force on the earlier of: (a) an Entrant submitting an Entry; or (b) an Entrant confirming acceptance of the terms and conditions in a Declaration, and will continue in force until: (a) if no Prize is awarded, Severn Trent notifying the Entrant that their Entry has been unsuccessful; or (b) if a Prize is awarded, all outstanding obligations in respect of such Prize are satisfied.

12 General

12.1 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12.2 Severn Trent reserves the right to impose additional reasonable conditions on the Prize where necessary.

12.3 If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.4 A failure by Severn Trent to exercise or enforce any right under these terms and conditions shall not constitute a waiver of that right.

12.5 These terms and conditions (together with the Entry, Declaration and any confirmation issued by Severn Trent) constitute the entire agreement between the Entrant and Severn Trent in relation to the Prize.

12.6 Any notice given under or in connection with the Entry and Prize shall be in writing and sent by email. Notices to Severn Trent shall be sent to communityfund@severntrent.co.uk and notices to the Entrant shall be sent to the email address set out in the Entry.

12.7 Severn Trent may update these terms and conditions from time to time on written notice to the Entrant.
